We want to update you on the lawsuit filed by FOGG and our twelve coalition partners.
This lawsuit, you will recall was filed against the City and County of San Francisco, SF Planning Commission, SF Port, SF Port Commission, San Francisco Waterfront Partners II, LLC; Pacific Waterfront Properties, and the California State Teachers Retirement System.
We are arguing that the Planning Commission’s endorsement of the Northeast Embarcadero Study and the Port Commission’s approval of the project term sheet together prejudiced the EIR process by essentially pre-approving the project.

FOGG will continue its efforts to preserve the City’s only outdoor swim and tennis recreational center (GGT&SC) regardless of whether Judge Harold Kahn accepts the Brief argument. We are entering a very intensive period of effort as the developer is giving every indication of trying to move ahead with his proposal as quickly as possible.
This means our attorney, Sue Hestor and consultant Brad Paul will be in overdrive with our volunteers to ensure our success. There is much to do, and it is our intention to complete our mission.
It takes, as you are well aware, an ongoing commitment to raise money for this effort.
FOGG doesn’t have the luxury of dipping into the California State Teachers Retirement System (CalSTRS) coffers, like Mr. Snellgrove, but we know we have thousands of concerned individual citizens on our team, many of whom continue to make tax deductible donations to save this jewel of a recreational center that provides so much to so many families, youngsters and seniors.
